Al - hisbah and Its Application in Indonesia

 Al - hisbah etymologically means counting , thinking , giving opinions , views , and others. While the term is defined Ibn Taymiyyah Al - Al - hisbah as an institution that aims to instruct the so-called goodness ( al - ma'ruf ) and prevent what is commonly referred to as evil ( al - munkar ) in the territory under the authority of the government to arrange it , try the other common area - specific , which can not be reached by ordinary institutions .
If seen from the definition above, the Al - Al - hisbah not only serves as an institution that oversees the market only ( economic ) but also to the field of law . Based on the study Hafas Furqani (2002 ) mentions several al - hisbah functions , namely :
1 . Keep an eye on the scales , sizes , and prices .
2 . Oversee the sale of illegal , the practice of usury , gambling , gharar and fraud .
3 . Supervise halal , health , and hygiene of a commodity .
4 . Arrangement ( layout ) market .
5 . Overcome disputes and injustice .
6 . Intervening in the market .
7 . Provide penalties for violations.
The foundation of Al - hisbah contained in Surah Al Imran verse 104 ;
" And let none of you class of beings who called on the virtues , sent to the ma'ruf and prevent it from being unjust , they're the lucky ones "

From the above presentation , it is clear that the oversight agency is very important in keeping the market mechanism run in accordance with its function . If we look at Indonesia , the role of al - hisbah will not be real because we see in Indonesia al - hisbah institution is not made into a supervisory agency independent special because it is the system adopted by the Indonesian government is not Islamic berasaskan although the majority of the population is Muslim so it becomes a natural thing happened . But even then the function al - hisbah in Indonesia has actually existed , it could be seen in the chart below surveillance in Indonesia :
From the above chart we can see the role indirectly al - hisbah been formed by the synergy of multiple agencies in an effort to control over the market, but when viewed from the definition and function of al - hisbah widely above the control flow represents only a small proportion of the role of al - hisbah . But at least it functions al - hisbah existing in Indonesia , represented by oversight agencies that emerged in Indonesia.
Agencies that have represented the function of al - hisbah in Indonesia is LPPOM - MUI is in the chart above , where the presence of MUI 's LPPOM - al - hisbah function in overseeing halal , health and hygiene of a commodity has been represented by the agency , then from in terms of the prohibition of buying and selling illicit containing usury , gambling , gharar and fraud in any economic activity that has been governed by its control through the DSN - MUI MUI issued a fatwa prohibition of the above activities . Besides market supervisory agency also represented by YLKI that serves to protect the rights of consumers to be met by the manufacturer and thus the producers would not go around making products that essentially harm the consumer in order to obtain greater profits . If the role of al - hisbah in Indonesia is examined more deeply , then we will find a number of institutions which in essence is part of a function Al – hisbah.
